When to hire a bond registration attorney

• You are buying property with a bank bond (first bond registration).
• You are switching banks and need to bond the property to a new lender.
• You need a second or further bond on an already-mortgaged property.
• You are restructuring a bond (amendment, variation).
• You need to cancel a bond after settlement or sale.

What to expect

Once the bank has approved your bond, it instructs a bond attorney on its panel. The attorney obtains your FICA, draws the bond documents, arranges signing, and lodges the bond at the Deeds Office in tandem with the transfer. The three linked lodgements (transfer, bond cancellation, new bond) must register on the same day. Registration typically happens 2-3 weeks after lodgement.

Typical fees

Bond registration costs are separate from transfer costs and also follow the Law Society guideline scale. On a R2M bond: approximately R24,000 + VAT + Deeds Office fees. On a R1M bond: approximately R18,000 + VAT + Deeds Office fees. Buyer pays.
